These Terms of Service (“Terms”) govern access to and use of upsihologa.com.ua, including all pages, accounts, psychologist profiles, directories, forums, comments, messaging features, “Ask a Psychologist” sections, paid services, subscriptions, and related services (collectively, the “Website” or the “Resource”).
The Website is operated by Iryna Uriupina, a trader and tax resident in New Zealand. The Website is hosted using third-party infrastructure providers, including servers physically located within the European Union.
By accessing or using the Website, you agree to these Terms. If you do not agree, you must stop using the Website.
1. Purpose of the Website
The Website is a Ukrainian-oriented psychology and mental-health platform intended to help users find psychologists, access educational materials, participate in discussions, ask psychological questions, and communicate with specialists.
The Website primarily serves Ukrainian psychologists and Ukrainian-speaking users, while also providing selected services and content internationally, including in English.
The Website itself is not an emergency service, psychiatric institution, medical provider, or crisis-response service.
If you are experiencing an emergency, suicidal thoughts, immediate danger, or require urgent psychiatric or medical assistance, contact local emergency or crisis services immediately.
2. No Guarantee of Psychological, Medical, or Professional Outcome
Content published on the Website is provided for informational, educational, directory, communication, and community purposes only.
Unless explicitly stated otherwise, the Website itself does not provide psychotherapy, psychiatry, medical treatment, crisis intervention, diagnosis, or emergency psychological care.
Psychologists, therapists, counsellors, supervisors, students, coaches, and other specialists listed on the Website are independent third parties.
The Website does not guarantee:
- the accuracy of their profiles or qualifications;
- the legality of their practice;
- the quality, effectiveness, or safety of their services;
- professional outcomes;
- compliance with regulations in any jurisdiction.
Users are solely responsible for deciding whether to contact, trust, hire, consult, or work with any specialist.
3. Eligibility
The Website is intended for adults aged 18 or older.
Users under 18 must not register accounts or submit personal data unless permitted by applicable law and authorised by a parent or legal guardian.
We reserve the right to reject registrations, suspend accounts, or deny access where necessary for safety, moderation, legal compliance, abuse prevention, or platform integrity.
4. Accounts and Registration
Registration is voluntary.

you explicitly consent to the processing, moderation, storage, publication, translation, and administration of the information you submit for the purposes of operating and maintaining the Website and its services.
You should not submit sensitive information unless you are comfortable with such processing.
You must not publish sensitive information belonging to another person without permission or lawful basis.
5. Ukrainian Safety Policy and Zero Tolerance for Russian Aggression Narratives
The Website operates in the context of Russia’s ongoing war against Ukraine and is intended to provide a safer environment for Ukrainian users, Ukrainian psychologists, displaced persons, and war-affected individuals.
We maintain zero tolerance toward content, behaviour, narratives, or activity that supports, excuses, justifies, minimises, denies, normalises, promotes, or shifts blame for the Russian Federation’s aggression against Ukraine.
This includes, but is not limited to:
- claims that Ukraine “provoked” the invasion through Maidan, democracy, NATO cooperation, language policy, resistance to occupation, or other political choices;
- narratives asserting that Russia “had no choice” but to attack Ukraine;
- blaming Ukraine or Ukrainians for the invasion or consequences of Russian aggression;
- denial or minimisation of war crimes, occupation, deportations, attacks on civilians, or destruction caused by Russian aggression;
- dissemination of Russian state propaganda or hostile disinformation;
- harassment or retraumatisation of Ukrainian users or psychologists.
We determine, at our sole discretion, what constitutes prohibited propaganda, hostile behaviour, anti-Ukrainian narratives, disinformation, or unsafe conduct.
We may remove content, reject content, restrict access, suspend accounts, permanently ban users, or refuse service without prior notice.
This policy is based on community safety, psychological safety, anti-abuse measures, and protection of vulnerable users. It is not based on race, ethnicity, nationality, or place of birth.
6. Other Prohibited Conduct
You must not:
- harass, threaten, stalk, intimidate, or abuse others;
- publish private information about another person without permission;
- spread malware, phishing, scams, or spam;
- scrape or mass-copy Website data;
- attempt unauthorised access to systems or accounts;
- impersonate another person or organisation;
- post illegal or defamatory content;
- publish explicit or disturbing content outside areas where permitted;
- exploit minors or vulnerable individuals;
- use the Website for unlawful or abusive purposes.
We may interpret and enforce these rules in context and at our discretion.
7. User-Submitted Content

- reproduce;
- moderate;
- display;
- publish;
- adapt;
- translate;
- edit;
- distribute;
- promote;
such content in connection with operation of the Website.
This licence continues even after account deletion unless applicable law requires otherwise.
8. Public Contributions, Account Deletion, and Anonymisation
Public contributions may become part of the Website’s archive and discussion structure.
We reserve the right not to delete public contributions that are not personal data, including:
- forum posts;
- public comments;
- psychologist questions;
- answers;
- reviews;
- discussions.
If you request deletion of your account or personal data, we may:
- anonymise;
- pseudonymise;
- redact;
- detach identifiers from public content
instead of deleting the entire discussion or contribution.
Deleting an account does not automatically require deletion of public content where retention is necessary for archive integrity, moderation history, community continuity, legal defence, safety, or legitimate Website operation.
9. Translation of User Content
The Website may operate in multiple languages, including Ukrainian, Russian, and English.
By submitting content, you grant us permission to:
- translate;
- machine-translate;
- localise;
- adapt;
- edit;
- display
your submitted content in other languages.
Translations may not always be perfect or fully accurate.
10. Advertising and Monetisation

Users are not entitled to compensation or revenue sharing from such advertising unless separately agreed in writing.

Professional titles such as:
- psychologist;
- therapist;
- counsellor;
- supervisor;
- student;
- coach;
- verified;
may have different meanings in different jurisdictions and should not be interpreted as legal certification or government endorsement.
Users are solely responsible for independently evaluating whether a specialist is qualified, lawful, suitable, or safe for their needs.
The Website is not responsible for acts, omissions, misconduct, malpractice, negligence, false representations, inaccurate credentials, or unlawful activity involving specialists listed on the platform.
Some specialists may only legally provide services in certain jurisdictions. Users are responsible for determining whether receiving services from a specialist is lawful where they are located.
12. Paid Services, Subscriptions, and Pricing
Some features may require payment or subscription.
We may:
- introduce;
- remove;
- modify;
- reprice;
- discontinue
free or paid features at any time.
Payments may be processed through third-party payment providers such as Stripe.
We do not store full payment-card information on our own servers unless explicitly stated otherwise.
13. Refunds, Cancellations, and Withdrawal Rights
Refund policies may depend on the type of service and applicable jurisdiction.
Unless otherwise stated:

- advertising placements;
- subscription features;
- paid visibility services
are non-refundable once activated, started, displayed, or used, except where required by law.
Subscription cancellation stops future renewals but does not automatically create refunds for current billing periods.

Where users request immediate access to digital services, we may ask them to acknowledge loss of withdrawal rights where legally permitted.
Accounts suspended for abuse, fraud, propaganda activity, security threats, or violations of these Terms may lose refund eligibility unless applicable law requires otherwise.
14. Moderation and Enforcement

We are not required to explain moderation decisions or engage in correspondence regarding them.
Failure to enforce a rule in one case does not waive our right to enforce it later.

These messaging features are intended primarily for:

Users should avoid sending highly sensitive, confidential, medical, financial, identity-related, or legally protected information through the Website’s messaging system unless they are comfortable with the associated risks.
The Website’s messaging system is not guaranteed to provide:

Where liability cannot legally be excluded, liability is limited to the amount paid by the user for relevant services during the preceding three months or NZD [AMOUNT], whichever is lower.

You agree to indemnify and hold harmless the Website, its operators, administrators, contractors, and service providers from claims, losses, damages, liabilities, or expenses arising from:

You agree that disputes relating to the Website or these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand unless applicable law provides otherwise.
Severability
If any provision of these Terms is found to be invalid, unlawful, unenforceable, or ineffective by a court or competent authority, that provision shall be interpreted to the maximum extent permitted by law or, where necessary, severed from these Terms without affecting the validity, enforceability, or effectiveness of the remaining provisions.
The remaining provisions shall continue in full force and effect.
